Terms and conditions

All auctions conducted are physical and online bidding, Online bids are to be submitted through the iBidder / BidSpotter platform. 

All auctions are conducted as “TRADE ONLY” sales (unless otherwise stated) not a consumer sale, by registering to bid all bidders agree to be bound by all of the terms and conditions and accept this prior to registering to bid with the intention to buy, This includes bidding in person, online by simulcast or any other means agreed with the auctioneer in writing prior to submitting any bid “IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS & CONDITIONS DO NOT REGISTER TO BID” as you will be bound by them. Successful winning bidders (RESERVE MET OR PROVISIONAL BIDS ACCEPTED) should understand any item fully prior to bidding on any lot(s) / item(s), The winning bidder acknowledges the terms and conditions and bids / buys with the understanding that no item(s) are warranted or guaranteed by capital asset remarketing or the vendor (unless otherwise stated) only if there is a valid manufactures warranty remaining or otherwise stated in each individual item description. All registrations to bid acknowledge and accept that this is a “trade only” sale and accept any winning invoice as under ‘Trade’ terms (Not a consumer). This sale is not for the purpose of the sales of goods act 1979. (As amended by the sales and supply of goods act 1994) and the Unfair contract terms act Regulations,1977 / 1999 and the buyer shall not seek to rely upon any conditions or warranties implied thereby. 

All potential bidders are advised to attend any physical auction as online bidding information supplied cannot be deemed correct or relied upon and are strictly for Guidance purposes only. 

All bidders are encouraged to make any investigations to fully satisfy themselves before bidding, by not making such investigations they do so at there own risk and against the advise of Capital Asset Remarketing / vendor(s). 

Capital Asset Remarketing strongly advise all registrations / potential bidders to read and fully understand all terms and conditions prior to registering and submitting any bids!

There are no exceptions or excuses for not doing so.

(1) Registering to bid.

There is a registration process, once any bidders account has been approved for bidding you will be free to bid on any items of interest

“if any further information is required to get your bidder account approved manually we will call or email to request further information"

By registering to bid, The account holder is responsible for all bidding activity on there account, If any bid(s) are submitted on behalf of the account holder by any other (Family member / Friend / Employee / Other) The account holder is fully responsible for all bids submitted without exception or excuses, Therefor the account holder is accepting responsibility for ALL bidding activity.

It would be our advise that all personal iBidder / BidSpotter account login details are not shared with anyone as all bidding activity falls on the account holder.

(1.1) How to bid.

By registering to bid in all of our sales, Bidders must be a minimum age of ’18’ years old or over, Should anyone under the age of 18 place a bid / win any item(s) the parent / guardian will be liable to settle any outstanding invoices, Should payment not be received within the payment deadline, Court proceedings will be applied in the Parent / Guardians name. (No exceptions)

(2) Bidding in physical & timed auctions.

All bids are valid with no exceptions. Vendors reserve the right to change / remove any set reserve price at any given time during any live auction without notification.

All bids submitted are taken as provisional unless the reserve price has been met before the end of sale. (See provisional (2.3) for further details)

(2.1) BUYERS PREMIUM COMMISSION / ADDITIONAL FEES: 

A Payable Additional Fee / Commission Applicable To All Lot(s) / Item(s) - This Commission Is Charged On top Of The Hammer Price / Bid Submitted. 

Commission rates may vary depending on Lot(s) / Item(s) - So remember to check ‘Additional Fees’ tab located on each individual item. - All Buyers Premium Commission charges are subject to VAT @ 20%.

• INVOICE DETAILS: Winning invoices will be issued after sale as ended, all invoices will be made payable to account details and or any other details provided or obtained. requests to change / updated invoice details can only be done so after the original invoice as been settled in full, change of details will incur a £50 + vat admin fee.
